TERMS & CONDITIONS (T&C)

1. SELLER / OPERATOR AND SCOPE
These Terms & Conditions apply to all purchases made via martinschgaguler.com (“Shop”).

2. PRODUCTS
The shop offers fine-art photographic works (e.g., archival pigment prints), in limited editions where stated.
Product pages describe available sizes, edition information, and what is included (e.g., certificate of authenticity where stated). Slight differences in colour can occur due to display calibration and do not constitute a defect.

3. ORDERING AND CONTRACT CONCLUSION
By completing checkout, you submit a binding offer to purchase. The contract is concluded when we confirm the order by email or dispatch the order.
We may refuse or cancel an order in justified cases (e.g., obvious pricing error, fraud suspicion, edition limitations). If payment was already made, it will be refunded.

4. PRICES, VAT, AND CURRENCY
All prices are shown in CHF.

• Prices are inclusive of Swiss VAT where applicable.

• For deliveries outside Switzerland, import duties/taxes may apply and are borne by the customer.

5. PAYMENT (STRIPE)
Payments are processed via Stripe using the payment methods offered at checkout. Orders are produced/dispatched after successful payment unless explicitly agreed otherwise.

6. PRODUCTION AND DISPATCH TIMELINE
Most artworks are produced and prepared specifically for your order.
Production/dispatch: typically 5–15 business days after order confirmation/payment (unless otherwise stated on the product page).

7. SHIPPING, DELIVERY, AND PACKAGING
We ship domestically and internationally. Works are carefully packaged to withstand transport (e.g., protective tube/flat packaging depending on format).
Delivery times depend on destination and carrier. Tracking is provided where available.

8. RETURNS / RIGHT OF WITHDRAWAL (SWITZERLAND)
Under Swiss law, there is generally no mandatory “cooling-off” or automatic right of return for online purchases simply because a buyer changes their mind; shops may offer one voluntarily. 
Therefore, we apply the following policy:

8.1 CANCELLATIONS
Because artworks/prints are often produced and prepared specifically per order, cancellations are only possible before production/packing begins. If you need to cancel, contact us immediately viaEmail . If production has started, cancellation may no longer be possible.

8.2 RETURNS (CHANGE OF MIND)
We do not offer returns or exchanges for change-of-mind purchases unless we expressly agree otherwise in writing.

8.3 TRANSIT DAMAGE / DEFECTS
If our shipment arrives damaged or defective, notify us within 48 hours of delivery and include photos of:

1. external packaging,

2. internal packaging,

3. the artwork,

4. shipping label.

   We will work with you to resolve the issue (replacement where possible, otherwise refund where appropriate).

9. LIMITED EDITIONS AND AVAILABILITY
Limited editions are sold subject to availability. If a work becomes unavailable after ordering (e.g., edition sold out), we will inform you promptly and refund any payment received.

10. CERTIFICATE OF AUTHENTICITY
Where stated on the product page, the artwork includes a signed and numbered certificate of authenticity.

11. INTELLECTUAL PROPERTY
All images, texts, and content on this website are protected by intellectual property rights. Any use beyond private viewing (copying, publishing, commercial use) requires prior written permission.

12. LIABILITY
We are liable for intent and gross negligence. For slight negligence, we are only liable for breaches of essential contractual duties and limited to foreseeable damages typical for the contract.

We are not liable for interruptions in website availability due to maintenance, third-party systems, or causes beyond our control.

13. DATA PROTECTION
Personal data is processed according to the Privacy Policy on this website.

14. APPLICABLE LAW AND JURISDICTION
These Terms are governed by Swiss law.
Exclusive place of jurisdiction is Basel, Switzerland, unless mandatory provisions provide otherwise.

15. SEVERABILITY
If any provision of these Terms is invalid or unenforceable, the remaining provisions remain in effect.
